Terms & Conditions — Poker Siege

These Terms & Conditions (“Terms”) are a binding agreement between you (“you” or “player”) and ROCKVINE GAMES - FZCO (“RockVine Games”, “we”, “us”, or “our”), the developer of the mobile game Poker Siege (the “Game”). They govern your download, access to, and use of the Game and any related services, content, and features (together, the “Services”).
By downloading, installing, or using the Game, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Game.
1. Eligibility & age
The Game is intended for a general audience and is not directed at children under 13 (or the minimum age required in your country to consent to use online services — for example 16 in parts of the EU/UK). If you are under the age of majority where you live, you may only use the Game with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Game you confirm that you meet these requirements and that the information you provide is accurate.
2. Licence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the Game on a device you own or control, for your personal, non-commercial entertainment only. We reserve all rights not expressly granted. This is a licence, not a sale; you acquire no ownership in the Game.
3. Accounts
Some features require an account or a sign-in (for example via your Apple or Google account and our backend providers). You are responsible for any activity that occurs under your account and for keeping your credentials and device secure. You may not share, sell, or transfer your account, buy or sell accounts, or use another player’s account. Provide accurate information and keep it current. Notify us promptly of any unauthorised use.
4. Acceptable use & conduct
You agree not to:
- cheat, exploit bugs, use bots, automation, modified clients, or any tool that gives an unfair advantage, or otherwise interfere with fair play;
- reverse engineer, decompile, disassemble, tamper with, or attempt to extract source code, assets, or server logic, except where this restriction is prohibited by law;
- access, probe, or disrupt our servers, networks, or the Services, or circumvent any security, rate-limiting, or anti-fraud measures;
- harass, threaten, defame, impersonate, or abuse other players or staff;
- choose or submit a display name or other content that is unlawful, offensive, hateful, sexually explicit, infringing, or that impersonates another person or brand;
- use the Game for any unlawful purpose or in violation of these Terms or applicable law.
We may monitor for, investigate, and act on violations, including by removing content, resetting names, restricting features, or suspending or terminating accounts.
5. Player content
You may submit limited content such as a display name or profile selections (“Player Content”). You retain any rights you hold in your Player Content. You grant us a worldwide, royalty-free, non-exclusive licence to host, store, display, and use your Player Content for the purpose of operating and improving the Services (for example, showing your name on leaderboards or to opponents). You are solely responsible for your Player Content and confirm you have the rights to submit it. We may remove or change any Player Content that violates these Terms.
6. Virtual items & in-game currency
The Game includes virtual currency (“Gold”) and other virtual items, buffs, and cosmetics (together, “Virtual Items”). You understand and agree that:
- Virtual Items are a limited licence to access game features, not your property, and have no monetary value and no value outside the Game;
- Virtual Items cannot be sold, transferred, traded, redeemed, or exchanged for real money, goods, or anything of value outside the Game;
- Virtual Items are generally non-refundable, except where a refund is required by the app store’s policies or by applicable law;
- we may create, manage, modify, regulate, balance, price, suspend, or remove Virtual Items at any time, with or without notice, and we have no liability for doing so;
- any Gold or Virtual Items associated with an account are forfeited if the account is terminated or closed.
7. Purchases & payments
The Game may offer optional in-app purchases (for example, packs of Gold). All purchases are processed by the relevant app store (Apple App Store or Google Play) under that store’s terms and payment methods — we do not collect or store your payment card details. Prices and availability may change. Taxes may apply. Refunds and cancellations are handled by the app store under its policies; please contact the app store for billing or refund requests. You are responsible for charges incurred on your account.
8. No real-money gambling
Poker Siege uses poker-style mechanics and in-game “wagers” of Gold for entertainment only. This is not gambling. There is no real-money betting, no prize of real-world value, and no way to cash out Gold or Virtual Items. Gold has no monetary value, is purchased and used solely for in-game entertainment, and outcomes do not result in any real-world winnings or losses. The Game is intended for players in jurisdictions where such entertainment is permitted; you are responsible for ensuring your use complies with your local laws.
9. Updates, availability & changes to the Game
The Game and Services are provided on an evolving basis. We may add, change, update, suspend, or discontinue features, content, game balance, servers, or the Game itself, in whole or in part, at any time, with or without notice. You may need to install updates to keep using the Game. Online features depend on third-party platforms and connectivity and may be unavailable from time to time.
10. Intellectual property
The Game and all related content — including code, artwork, characters, audio, music, UI, text, trademarks, and the “RockVine Games” and “Poker Siege” names and logos — are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited licence in Section 2, these Terms grant you no rights in any of our intellectual property. Fonts (Cinzel, SIL OFL) and emoji art (Twemoji, CC-BY 4.0) are used under their respective licences.
11. Third-party services
The Game relies on third-party services and platforms (including the Apple App Store, Google Play, our hosting and accounts providers, and any advertising or analytics partners). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
12. Disclaimers
To the maximum extent permitted by law, the Game and Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, secure, or free of harmful components, or that data, progress, or Virtual Items will never be lost. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, in no event will RockVine Games or its owner, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, progress, or Virtual Items, arising out of or relating to the Game or these Terms, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Game will not exceed the greater of (a) the amount you paid us (or via the app store for in-app purchases) in the 12 months before the claim, or (b) USD 50. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnification
You agree to indemnify and hold harmless RockVine Games and its owner and affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Game, your Player Content, or your breach of these Terms or of applicable law, to the extent permitted by law.
15. Suspension & termination
We may suspend, restrict, or terminate your access to the Game or your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in cheating, fraud, or abuse, or to protect the Game or other players. You may stop using the Game at any time by deleting it. On termination, your licence ends and any Gold and Virtual Items associated with the account are forfeited. Sections that by their nature should survive (including 6, 10, 12, 13, 14, and 17) will survive termination.
16. Apple App Store & Google Play terms
If you obtained the Game from the Apple App Store, you acknowledge that: these Terms are between you and RockVine Games only, not Apple; Apple has no obligation to provide maintenance or support for the Game; Apple is not responsible for any product warranties or for addressing any claims relating to the Game (including product-liability, legal/regulatory, or intellectual-property claims); and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you obtained the Game from Google Play, your use is also subject to the Google Play Terms of Service. You confirm you are not located in a region subject to relevant embargoes and are not on any prohibited- party list.
17. Governing law & disputes
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws rules. You agree that the courts of Dubai, United Arab Emirates will have jurisdiction over any dispute, except where mandatory consumer-protection laws in your country of residence provide otherwise. Where required, nothing here deprives you of the protection of mandatory provisions of your local law.
18. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide notice in the Game or on our website. Changes take effect when posted. Your continued use of the Game after changes take effect means you accept the updated Terms.
